These Terms of Service (“Terms”) govern your access to and use of the website located at byteforgeco.com and any related services (collectively, the “Services”) provided by BYTEFORGE TECHNOLOGIES LTD. Engagement to deliver professional services is governed by a separate written agreement (a statement of work or master services agreement). Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from our content without our prior written consent. “BYTEFORGE” and the ByteForge logo are trademarks of BYTEFORGE TECHNOLOGIES LTD.

The Services may link to or include content from third parties. We do not endorse and are not responsible for third-party sites or content. Your dealings with third parties are solely between you and them.

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, ByteForge disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that information on the Services is accurate, complete, or current.

To the maximum extent permitted by law, in no event will ByteForge, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or in connection with the Services is limited to one hundred Canadian dollars (CA$100).

You agree to indemnify and hold harmless ByteForge and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the Services.

We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada for the resolution of any dispute arising from or relating to these Terms or the Services.

13. Changes to these Terms

We may modify these Terms from time to time. The “Last updated” date at the top reflects the latest revision. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

14. Entire agreement and severability

These Terms (together with our Privacy Policy and any separate written agreements) constitute the entire agreement between you and ByteForge regarding the Services. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
