These Terms of Service (“Terms”) govern your access to and use of the website located at byteforgeco.com and any related services (collectively, the “Services”) provided by BYTEFORGE TECHNOLOGIES LTD. (“ByteForge”, “we”, “us”, or “our”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

By accessing the Services you confirm that you are at least the age of majority in your province, territory, or country of residence, and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Description of the Services

ByteForge provides information about our company and the software, web, AI, automation, and digital product services we offer. Engagement to deliver professional services is governed by a separate written agreement (a statement of work or master services agreement). Nothing on this website constitutes an offer capable of acceptance unless and until such a written agreement is signed.

4. Acceptable use

You agree not to:

• Use the Services in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to our systems, networks, or data, or interfere with their operation.
• Reverse engineer, decompile, or disassemble any part of the Services except to the extent permitted by law.
• Use any automated means to scrape, harvest, or extract data from the Services without our prior written consent.
• Upload, transmit, or distribute viruses, malware, or other harmful code.
• Misrepresent your identity or affiliation, or impersonate any person or entity.

The Services, including all text, graphics, logos, designs, code, and other content, are owned by ByteForge or our licensors and are protected by copyright, trademark, and other laws of Canada and other countries. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from our content without our prior written consent. “BYTEFORGE” and the ByteForge logo are trademarks of BYTEFORGE TECHNOLOGIES LTD.

6. Submissions and feedback

If you send us suggestions, ideas, or other feedback, you grant ByteForge a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, and incorporate the feedback into our products and services without obligation to you.

The Services may link to or include content from third parties. We do not endorse and are not responsible for third-party sites or content. Your dealings with third parties are solely between you and them.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, ByteForge disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that information on the Services is accurate, complete, or current.

9. Limitation of liability

To the maximum extent permitted by law, in no event will ByteForge, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or in connection with the Services is limited to one hundred Canadian dollars (CA$100).

You agree to indemnify and hold harmless ByteForge and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the Services.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada for the resolution of any dispute arising from or relating to these Terms or the Services.

13. Changes to these Terms

We may modify these Terms from time to time. The “Last updated” date at the top reflects the latest revision. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

14. Entire agreement and severability

These Terms (together with our Privacy Policy and any separate written agreements) constitute the entire agreement between you and ByteForge regarding the Services. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
